The Economic Freedom Fighters (EFF) is not fazed by AfriForum’s announcement that the National Prosecuting Authority (NPA) will pursue a charge of crimen injuria against President and Commander-in-Chief of the EFF, Julius Malema.

The pursuit of this by the NPA at the behest of the racist reincarnation of the Boeremag in the form of AfriForum, is part of a vindictive ideological agenda by right wingers, who cannot bear the influence that the EFF and its leader continue to hold in various spheres of government and society.

The background of this case stems from October 2024 when the seven-year- old “CweCwe” rape matter was reported to have occurred at her school. As part of that investigation, the principal of the school where she was a learner refused to voluntarily provide his DNA sample as requested by the South African Police Service (SAPS) in their child rape investigation.

The school principal was one of three people who SAPS requested to voluntarily provide their DNA sample as a process of elimination in its child rape investigation. The school principal was the only one who refused to cooperate with the SAPS and instead, accepted the services of the white supremacist group, AfriForum who went on its usual mission to protect the ‘rights’ of a white man over the human rights of an African child.

As a result, President Malema spoke as a political leader responding, in real time, to a case that had already generated public outrage, noting this refusal by the principal. His remarks were a political statement of outrage on behalf of a child and a grieving family, not a legal pronouncement, and they must be understood in that context, as a political statement at a political event in defence of an unspeakable crime against a child.

The fact that he is a school principal, and that the minor was in his care as a school principal, must not be neutralised. It speaks directly to the fact that AfriForum’s white supremacist positioning in South Africa has no bounds, even when it comes to the rape investigation involving an African child.

Why, in an investigation into a reported rape of a seven-year-old child, did a school principal decline to voluntarily provide a DNA sample as part of an SAPS investigation elimination process? An adult’s comfort or reputation must never be placed above a child’s right, under our Constitution and the Children’s Act, to have their allegations properly and thoroughly investigated. Considering that a voluntary DNA sample to assist in the investigation could have gone a long way in moving the case forward, the refusal to do so was a matter that legitimately called for public outcry.

The EFF has always been at the forefront against the war against our children, we have always protected and fought for justice for children who are subjected to daily atrocities, and the CweCwe child rape investigation was no exception. It is our political duty to fight for children, particularly because recent statistics show 3,258 cases of sexual abuse in the first three quarters of the 2025/26 financial year, while statutory rape cases have also increased significantly, reflecting a disturbing escalation in sexual violence against children.

It is our political duty to ensure that anyone who commits harm or appears to have caused harm to a child is pursued decisively, and it is our political duty to always prioritise the rights of a child over an adult. We do so unapologetically and AfriForum, even with the might of Donald Trump, will not silence us.

AfriForum’s relentless political prosecution against the President of the EFF has reached an unprecedented low in weaponising the justice system in a child rape investigation by unseeing the rights of a 7-year old African girl child for the ‘rights’ of an adult white man who is a school principal. This is precisely the pattern the EFF has highlighted as the white supremacist self-serving nature of AfriForum.

The EFF lodged a complaint with the SAHRC on the 19th of June 2025 against AfriForum and their spokesperson Barry Bateman for the violation of CweCwe’s human rights under complaint number HO25260015, following their public statements that CweCwe “was not raped”. It must be noted that these statements were made prior to the investigation being concluded.

According to SAHRC, AfriForum has not formally responded to its subsequent correspondence. However, AfriForum has aggressively pursued SAPS and the NPA on behalf of a white male school principal while dismissing the human rights of a seven-year-old African child. Furthermore, CweCwe’s family’s legal team is at an advanced stage in pursuing private prosecution as the legal team has received a copy of the docket, a development that coincides with AfriForum’s presentation to the NPA seeking prosecution of the CIC.

The cowardice of SAPS, NPA, and SAHRC is unsurprising as it is a reflection of President Ramaphosa’s government, which has consistently allowed AfriForum’s treasonous acts to go unchecked.

The EFF, therefore, makes no apology for protecting and pursuing the human rights of a child over that of an adult. This case is not just against the CIC, it is against the EFF, and more importantly, it is against the prioritisation of the protection and justice of children in a country that has unprecedented crimes against children.
